Alexei Schacht

Alexei Schacht is a lawyer whose practice focuses on criminal defense in Federal and New York State Courts. He represents clients in all types of criminal matters including government investigations, extraditions, grand jury hearings, jury and bench trials and appeals. He also represents clients in complex civil litigation.

Mr. Schacht received his BA from the University of Wisconsin at Madison, majoring in Political Science. He received his JD from the State University of New York at Buffalo, where he was a member of the Moot Court Honor Society and a finalist and multiple award winner in the Charles S. Desmond Moot Court Competition. Mr. Schacht was also the News Editor of the law school newspaper, The Opinion.

 

Following law school, Mr. Schacht was hired by Robert M. Morgenthau as an Assistant District Attorney in the New York County District Attorney’s Office. At the District Attorney’s Office he handled investigations, trials and appeals of a wide variety of cases ranging from shoplifting to murder. He had the privilege of working there from 1989 until 1995 when he left to enter private practice.

Since that time, Mr. Schacht has handled a wide variety of cases (including, but not limited to, narcotics conspiracy charges, money laundering, murder, and Medicare fraud) in Federal and State courts in New York, New Jersey, the District of Columbia, Florida, Connecticut, South Carolina and Pennsylvania. He has a well-known history of winning jury trials and appeals and of obtaining reduced sentences through negotiation. He is renowned for his hard-work, creativity, track-record of success and total dedication to his clients.

Graduated John Jay College of Criminal Justice with a four year degree in humanities and justice studies. Assists in most cases that are handled by Alexei Schacht by speaking to family members to keep them up to date with family and how the case is going.

Historic Case

United States v. Feithert Aponte a/k/a “Tomas” (Eastern District of New York) – Mr. Schacht obtained a 77 month sentence for this high profile member of the organization of “Los Comba”,despite the fact that the defendant was accused of multiple homicides and was a member of an organization trafficking massive amounts of cocaine.

Successful removal from OFAC (Clinton List)

Nebio Echeverry, the governor of Guaviare in Colombia sued with success the government of the United States. Once the complaint was made his name was removed from the OFAC list.

Sentence reduced

United States v. Gennady Klotsman (Eastern District of New York) – judge grants downward departure in complex organized crime securities fraud case that was the basis for the book “The Scorpion and the Frog.”

Appeal won

United States v. Dennys Alba (Second Circuit Court of Appeals) – sentence vacated where the judge departed without providing proper notice to the parties and did not make appropriate and necessary factual findings to support that sentence.

Not guilty verdict

People v. Franklin Garcia Bernal (Bronx County Supreme Court) – jury acquits defendant of possession with intent to sell 7oz. of cocaine where police found narcotics in the bed of the truck the defendant was driving.

United States v. Samark Lopez Bello (United States District Court for the Southern District of New York) – representation of Venezuelan businessman accused of violating OFAC sanctions.

Favorable sentence

People v. Mercedes Cha (Westchester County Supreme Court) – defendant sentenced to probation in vehicular manslaughter case after intense lobbying campaign on her behalf.

Historic Case

United States v. Dairo Antonio Usuga-David a/k/a “Otoniel” – representation of the alleged leader of the “Clan del Golfo” in the United States District Courts in Brooklyn, Miami and Manhattan.

Case dismissed

People v. Alexander Vacaj (New York County Supreme Court) – attempted murder indictment dismissed where a thorough investigation of the complainant revealed that she was an unreliable criminal and not an innocent “victim.” She then opted to plead the Fifth Amendment rather than appear in court and face cross-examination.

Not guilty verdict

People v. Jeffrey Bruno (Kings County Supreme Court) – jury acquits defendant of gun possession where police found a gun under defendant’s car seat; at the time defendant was alone driving his car.

Historic Case

United States v. Juan Carlos Ramirez-Abadia a/k/a “Chupeta” (Eastern District of New York)- Mr. Schacht was one of the attorneys who represented with great success this historic figure in the Cartel del Norte del Valle.
